Privacy Policy

Scope

This privacy notice explains how and why personal data is collected by the Uber Worker Claims Portal (“Portal”). It is intended to supplement the information available in Uber’s main Privacy Notice, and it uses the same headings found in that notice. Users should ensure that they read this supplemental privacy notice alongside the aforementioned Privacy Notice, which also applies to users of the Portal.

This privacy notice applies to any user of the Portal. That includes claimants (who may be current or former drivers), as well as representatives who file a claim on behalf of one or more claimants.

The data we collect
Uber will collect personal data that:
  • you submit through the Portal in support of your claim, or to establish your identity;
  • Uber or one of Uber’s service providers obtains from information already held about a driver in Uber’s records or from publicly available sources, as necessary to investigate and settle a claim; and
  • is collected automatically through the use of cookies and related technologies (please refer to the Cookie Policy).
The following data is collected by or on behalf of Uber:
  • Account Data. Your name, email address and password, which are used to create a unique user account for you to access the Portal. We will also ask you to confirm whether you are registering an account for yourself or on behalf of someone else (i.e. where you are acting as the representative of a claimant).
  • Claim Data. The name and date of birth of the driver(s) who are making a claim through the Portal, as well as the phone number and email address that each driver has previously registered with Uber for their Uber account.
  • Additional Driver Data. Records held about drivers by Uber (refer to Uber’s Privacy Notice for more information), as well as any publicly available information about a driver relevant to a claim where there is a need (in rare cases) to investigate the validity of a claim.
  • Identity Verification Data. Two valid forms of official identification uploaded to verify the identity (name and address) of each driver making a claim.
How we use personal data
Uber will use the data we collect through the Portal to:
  • create a user account;
  • verify the identity of each driver making a claim;
  • investigate and settle a claim;
  • respond to any challenges or complaints regarding our settlement of a claim through the Portal; and
  • allow the Portal to function as intended.

Grounds for processing
Uber has a legitimate interest in managing and processing claims for historic holiday pay compensation by current and former drivers, and it is necessary to collect the personal data described above in order to realise that interest. Uber’s legitimate interest benefits drivers, and care will be taken to ensure that personal data is not processed in a way that unduly infringes on the rights and freedoms of drivers or other relevant data subjects.

Data sharing and disclosure
Personal data may be shared with, or collected on our behalf by, a number of third parties who help Uber to administer the Portal and to investigate and settle claims. In particular (but without limitation), the Portal and overall claims process is managed by Ankura Consulting Group, and legal advice on claims is obtained from DLA Piper (a law firm).

Uber put in place appropriate contractual terms with service providers who process personal data on our behalf, or to whom we disclose personal data.

In addition, Uber may need to disclose personal data for legal reasons or in the event of a dispute, as further explained in our Privacy Notice.

Personal data controller
Ankura operates this portal on behalf of Uber. Uber is the data controller as stated in the Privacy Notice, and Ankura is a data processor. Ankura Consulting (Europe) Limited, incorporated and registered in England and Wales with company number 05402379 (“Ankura”) has its registered office at 100 New Bridge Street, London EC4V 6JA.
